Our Expert Department was established after the appointment of one of our Partners to act as Dubai Courts Listed IP Expert and later as a listed expert with Ministry of Justice, the UAE Feral Court and the Judiciary Department of Abu Dhabi. We offer wide range of expert consultancy services, such as, conducting Market survey, mark availability surveys, trademark valuation surveys, Expert Cases Management, Consultancy Reports.

Our Achievements

The Team of Abutaha Intellectual Property of lawyers and consultants has been involved and handled the following representative matters within the UAE:

• Recently we succeeded in obtaining a final ruling from the UAE Federal Supreme Court in favor of one of our clients against one of the largest tobacco industries in the world, where the dispute was related to an objection to the registration of our client’s trademark.
• Representing a well-known sound recording company and the owner of one of the biggest YouTube channels for publishing, producing, and broadcasting of records enforcement of music rights and neighboring rights, in numerous actions.
• Established 14 judicial rules as adopted by the Dubai Court of Cassation and the Federal High Court, which are considered a very important rule for shedding the doubt that kept lingering around the wrongful application of the well-settled international IP practice and changing the IP dispute resolution game in UAE.
• Represented a number of international and local clients in trademark registration. Our client has received a satisfactory result by registering their trademark worldwide and making use of our packages that covers (GCC, CTM (27 European Countries), the Middle East, Africa, Asia, the USA, and others).
• Involved in representing an Asian Company in pending litigation of trademark infringement and passing off of products in the office stationery industry.
• Involved in representing a Multinational Corporation in pending litigation, the Plaintiff in a trademark trade name dispute in which a retailer registered a trademark that is the same as one of the plaintiff’s trademarks. The case involves trademark infringement and unfair competition. The case represents cutting-edge issues in this developing area.
• Representing in pending litigation of a Multinational Corporation (Publishing Sector) on trademark issues and copyright issues arising out of the unauthorized use of a trademark of our client as a trading name and as a domain name on the content of the infringer’s website “Cyber Squatting”.
• Represent a Manufacturer/Distributor against unauthorized use and development of its product and the use of products advertising materials, which infringes the trademark, and copyrights of our client.
• Representing in a pending litigation an Oil Production Company in trademark issues before Public Prosecutor Criminal Courts.
• Represented a Multinational Company and the case went through the three tiers of litigation in favor of our client in a trademark–trade name dispute.
• Represented a Multinational Franchiser on trademark infringement cases in the UAE.
• Represented a Television Channel and Media Company on IP-related issues such as licensing, and branding each contract issue.
• Represented individuals on IP-related issues such as privacy issues and unauthorized use of photos and defamation by publishing companies.
• Represented a locally sponsored Cigarette Manufacturer in a trademark dispute and defended our client before customs, public prosecutors, and most UAE Criminal Courts.
• Appointed by the Dubai Courts (First Instance and Court of Appeal), and prepared and drafted reports in all sorts of IP protection and Cancellation Cases.
• Represented Multi-National Corporations in IP and Commercial arbitration.

We have established more than 25 Judicial Rules, that were well recognized and adopted by the higher courts of UAE.
